At MMagic we take care of our customers and make sure that they get the best quality products. Customer satisfaction is really important to us. Any purchases made at our retail stores or our website can be returned for a credit note equivalent to purchased goods value or exchange, within 14 days of purchase. Mermaid Magic Ltd. reserves the right to refuse the return if any of the following conditions are not met:
1) Products bought are not damaged and in the original condition and packaging.
2) Return date is within 14 days from the date of invoice
3) Returns are made only in the retails stores.
After receiving your product and matching above mentioned conditions we will refund the purchase price in form of a MMagic credit note or gift card. We will not refund the delivery costs if you are returning a non-faulty product. If we find that the returned product has a manufacturing defect or fault we will refund both the price you paid for the product and the delivery costs, but again in the form either credit note or exchange. If products has been damaged in transit please inform us on 0800662442 and we will arrange to replace the damaged products.
For corporate or bulk purchases from our retail stores or website, returns can only be made if products get faulty or damaged in transit. MMagic will attempt to replace the damaged or faulty goods or, where this is not possible; we will issue a credit note for the purchase value and agreed freight charges. Warranties and limited liability
MMagic will pass on the benefit of any warranties offered by our manufacturers or suppliers of the products we sell, directly to you. We clearly exclude to the fullest extent permitted by law all other warranties, descriptions, representations or conditions whether implied by law, trade, custom or otherwise. Our liability for any damages, loss, claims or expense related to the goods or services supplied by us is limited to just the cost paid by you for the goods or services except where statute explicitly requires otherwise. To the fullest extent permitted by law we are not liable in any event whether in tort (including negligence), contract or otherwise for any loss of profits or any indirect damage suffered by you or any other person.
Important Notices
Changes in policy
If we decide to change our policy and terms completely or partially, a notice will be flagged on our website. Once posted, the new policy will go into immediate effect, replacing any previously stated policy. By using this website, you have agreed to be bound by any changes in the policy and should therefore refer to current terms of use, periodically yourself.
Waiver
If at any time we do not enforce any of these Terms or grant you time or other indulgence, we will not consider waiving that term or our rights to later enforce that or any other term.
Severability
If any portion of these Terms is deemed to be invalid, illegal or unenforceable the remaining provisions shall remain in full force and effect.
Governing Law
These Terms are governed by New Zealand law and you agree to submit to the exclusive jurisdiction of the New Zealand Courts. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
